Donations

Kidney Cancer UK welcomes donations from individuals, organisations and companies, including pharmaceutical companies. The charity only accepts funds that are unrestricted and not designated for a narrowly defined purpose.

Online Purchases

We accept all orders placed and paid for online, subject to stock availability, with confirmation of acceptance of the order being sent to the purchaser by Email.. Were we take the order over the phone for products displayed on our online shopping, the order is confirmed by taking payment from a debit card or credit card (1.5% is added to the total cost of the item). If paying by Cheque, we will not release an order until payment has cleared with our Bank.

Subject to further validation checks that we may make regarding the order, our acceptance of the order by our email brings into effect our terms to supply. None stock items and customer special orders are not able to be cancelled once the order is accepted and confirmed.

Auction Bids

Bidding on an item and providing the charity with a name, email address and amount, makes the bidder liable to pay the Kidney Cancer UK the auction price bid if that price be the highest received.

Shipping and Handling:

Packing and other delivery charges are not included in the price of goods sold on line, unless stated at point of display.

Delivery Schedule

On receipt of your order we will email back confirmation of our acceptance of the order. An invoice and receipt will be posted to you. Unless otherwise agreed, the Kidney Cancer UK will only make deliveries to post codes that are confirmed to either the Debit or Credit Card used to make the purchase. the Kidney Cancer UK will not arrange deliveries to PO box address’s.

Delivery Times

We aim to despatch as follows:

  • Postal Items: Within 7 Days.
  • Van delivery items: Within two-weeks, although this cannot be guaranteed, as it depends mainly on the whereabouts of your location. It might not be possible to deliver to some locations and in relation to export from the United Kingdom a specific arrangement must be made before we are able to confirm a delivery.

Delivery of goods to you:

Where agreed we will deliver the goods ordered by you to the address given to us for delivery at the time the order is confirmed.

Delivery will be made as soon as possible after the order is accepted and in any event within 30 days of the order. Always excepting that Customers special orders might take longer

The customer becomes the owner of the goods they have ordered when they have been delivered to the customer Once goods have been delivered they are held at the Customers own risk and the Kidney Cancer UK will not be liable for their loss or destruction.

If a customer collects the goods or arranges for their collection by a third party then the Customer will become the owner of the goods when so collected whereupon Kidney Cancer UK will not be liable for their loss or destruction.

It assists us the Kidney Cancer UK to clearly defined our commitments to supply goods purchased from our on-line product range; which are set out below;

Before Delivery:

It is the customers responsibility to advise Kidney Cancer UK at the time of purchasing an item of difficulties that may be encountered when delivering to a property ensuring this information is documented on the sales receipt. Any costs incurred effecting delivery will not be the responsibility of Kidney Cancer UK.

Kidney Cancer UK is only responsible for delivery of goods to the customers front door

It will be at the discretion of the delivery agent for providing assistance within any property, and Kidney Cancer UK will not be responsible for any damage incurred whilst doing so.

Delivery dates and times are offered in good faith but Kidney Cancer UK cannot be held responsible for any direct or indirect loss due to any reasonable delay or delays due to unforeseen circumstances outside of our reasonable control.

If for any reason goods cannot be delivered due to access problems, it will remain the property of the customer, any further attempts to deliver by Kidney Cancer UK, is likely to incur a further delivery charge.

Right for you to cancel your contract:

The customer may cancel the contract with us for the goods you order at any time up to the end of the seventh working day from the date of receiving the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. This right to cancel does not apply to any item which was a special Customer order;

To cancel your contract you must notify us in writing:
If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. And in a condition as NEW .Should you cancel your contract, but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

Once you have notified us that you are cancelling your contract, any sum Credited to the Kidney Cancer UK from your debit or credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order; Provided always that the goods in question are returned by you and received by us in the condition they were in when delivered. If you do not return the goods delivered or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited

Cancellation by us:

We reserve the right to cancel the contract between us if:

  • we have insufficient stock to deliver the goods you have ordered; or an item is on back order with no indication being given to the Kidney Cancer UK by a Manufacture as to its availability
  • we do not deliver to your area; or
  • one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. Kidney Cancer UK will not offer any additional compensation for disappointment suffered.

Accuracy of Website:

We have taken every care in preparing the content of this website, however we cannot guarantee that the information will always be completely up to date and free from mistakes. To the extent permitted by law Kidney Cancer UK disclaims all warranties express or implied, as to the accuracy of the information contained on this website.

Descriptions of goods are given in good faith and the Customer should satisfy themselves on any particular issue of provenance or quality.

Liability:

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 5 working days of the delivery of the goods in question.
If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.
If you notify a problem to us under this condition, our only obligation will be, at your option:

  • to make good any shortage or non-delivery;
  • to replace or repair any goods that are damaged or defective(if available); or
  • to refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition, and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as above.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer neither under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Colour Reproduction:

Kidney Cancer UK have made every effort to reproduce colours on the site as accurately as possible. However, different computers reproduce colours in slightly different ways. Therefore, the product may vary in colour slightly to that shown on your screen.

Returns Policy:

Without prejudice to your right of cancellation set out above and other statutory rights you may have if a return is agreed upon, any delivery or postage costs will not be refunded, and re-collection fees may apply. Also, if any damage occurs during delivery a claim will be made to the couriers, who will again, possibly not return any delivery costs. the Kidney Cancer UK accepts no responsibility for lost or damaged items.

Events beyond our control:

Kidney Cancer UK have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Invalidity:

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Privacy:

Governing Law:

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement:

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

The Information Standard – Dislaimer

Kidney Cancer UK is a member of The Information Standard, a certification programme for health and care information supported by NHS England.

Kidney Cancer UK shall hold responsibility for the accuracy of the information they publish and neither the Scheme Operator nor the Scheme Owner shall have any responsibility whatsoever for costs, losses or direct or indirect damages or costs arising from inaccuracy of information or omissions in information published on the website on behalf of Kidney Cancer UK.

User-generated information is excluded from the scope of certification: weblogs, forums and personal experience pages – except where personal experience pages have been produced through a systematic process of validation.

Moderation Policy

Our social media accounts and patient/carer forum will be monitored regularly for any negative or adverse comments, and any errors or misinformation. If any negative or adverse comments or errors/misinformation are noticed on any of our social media accounts or other platforms, including the forum, these will be passed on to the our Marketing and Communications Executive who will be able to investigate and respond to the comments in an appropriate manner, if necessary.

Every comment is regarded an opportunity to further develop our personality and reputation and to build relationships. By responding thoughtfully, we can help to turn a bad situation into a positive experience and also to publicly correct errors/misinformation. In worse case scenarios, posts that include vulgar or inflammatory language are to be removed. Negative posts are left unanswered, especially if a response is likely to incite the author into further action.
